Understanding the planning process and how applications are reviewed

Considering and commenting on planning applications is, in terms of time taken, one of the most resource intensive tasks undertaken by the Parish Council.

The Parish Council is consulted by Stroud District Council (the Local Planning Authority) as a statutory consultee for planning applications within the parish. The Parish Council is not a Planning Authority and cannot approve or reject planning applications.

The final decision rests with Stroud District Council Local Planning Authority. The majority of application decisions are delegated to Stroud District Council planning officers. Large scale, more important, or controversial decisions can be made by Stroud District Council Development Control Committee.

The Parish Council is required to assess each planning application on its own merits, taking into account both Local and National Planning Policy as well as other material considerations.

The Parish Council is supportive of good development within the designated development area and of a reasonable / practical interpretation of policy.

Only comments which relate to material planning considerations can be taken into account in the determination of a planning application.  These include (but are not limited to) issues such as:

  • Overlooking/loss of privacy
  • Loss of light or overshadowing
  • Parking
  • Highway safety
  • Traffic
  • Noise and disturbance
  • Effect on listed buildings and/or conservation areas
  • Are the design, appearance and materials appropriate for the area
  • Is the extent or scale in keeping with the immediate area
  • Policies and proposals in the Neighbourhood Plan, Local Plan, and the National Planning Policy Framework Development, or emerging Plans
  • Central government policy and guidance
  • Disabled persons' access
  • Previous planning decisions (including appeal decisions)
  • Nature conservation
  • Infrastructure capacity – i.e. school and doctors places

Comments relating to non-material planning considerations will not be taken into account. These include (but are not limited to) issues such as:

  • Loss of view
  • Effect on the value of properties
  • Loss of private/acquired rights to light
  • Boundary disputes and private land ownership issues
  • Legal covenants
  • Private rights of access
  • Speculation over future use
  • The fact the development has already been carried out and the applicant is seeking to regularise the situation
  • The developer's motives, record or reputation
  • Matters which relate to other regulatory regimes such as Building Standards or Health and Safety

Parishioners are encouraged to submit comments on planning applications where appropriate. Comments that are clear, concise, accurate and where possible, reference planning policy stand more chance of being accepted by the Local Planning Authority.
